8. Child Fees

Pre-proceedings

Before we can make an application to court, we have to try to resolve matters by agreement. This means we have to write to the other parent with your proposals.

This package includes:

  • A full attendance for up to an hour.
  • A letter of advice to
  • Writing to the other parent with your proposals
  • Referral to mediation (we have to make a referral unless there is exceptional reasons i.e DV)
  • Review meeting once we have a response from the other parent to discuss options; OR
    Review meeting after 14 days if there is no response from the other parent to discuss your options

This does not include making any applications to court.

Contested packages
If no agreement can be reached, you will have to make an application to court. The following package will provide you with advice and assistance up to and including the first initial Court hearing and includes:

  • A personal appointment of up to one hour for the purpose of providing advice and gathering information.
  • All telephone calls and letters to you, the Court and the other side until the first hearing is complete.
  • Drafting and filing the Application at Court and serving the papers (by post) on all Respondents.
  • Preparing the initial Court bundle.
  • Attendance at the First Hearing (FHDRA) at Court to represent you.
  • Travel to and from Court within 1 hour of the office.

If the initial hearing does not resolve matters by agreement, the Court will consider the CAFCASS recommendations and may order a report, a review of interim arrangements or that the parties proceed to a final hearing. If your case is listed for a further hearing then we will need to discuss future costs with you, which will be based upon our usual hourly rate.

*Price quoted does not include Court Fees. Court Fees are set by the Courts and at present £215 on time of publication of our prices.

6. Non-Molestation and Occupation packages

Non-Molestation Order

Applicant
We can assist you to obtain a Non Molestation Order which is a form of injunction to prevent a person associated with you from harassing, pestering, using or threatening violence against you. Breach of a Non-Molestation Order is a criminal offence.

Our Service includes:

  • Preparing and issuing the Court application, which can be done on an emergency basis the same day if the circumstances are so serious that you require immediate and urgent protection (subject to our availability and / or that of a barrister).
  • Correspondence with the other party, or their solicitor and advising you in the office
  • Drafting statements
  • Preparing the statement of issues and chronology and sending all documents to Court for a return date hearing
  • Liaising with experts / professionals and instructing them to prepare further reports / arranging for their attendance at Court
  • Preparing the Court bundle
  • Liaise with you to select a barrister to represent you at any contested hearing and prepare a brief to the barrister (barristers fees are payable separately)

This does not include:

  • Any advice on divorce, children, or financial issues
  • Occupation orders
  • Court fees, process server fees or any other professionals / expert fees g. GP fees, police disclosure fees, process servers fees
  • Barristers fees
  • Representation at Court (which is charged separately and set out below)

You may be eligible for help with the Court fee under the Court fee remission scheme. This will be discussed with you and assistance provided to complete the application, if applicable, within the fixed fee quoted.

Respondent

Non-Molestation and occupation order

We can assist you to obtain a Non-Molestation Order which is a form of injunction to prevent a person associated with you from harassing, pestering, using or threatening violence against you. This can be combined with an occupation order. Occupation orders are orders made by the courts to enforce, declare or restrict rights to occupy the matrimonial home.

We can help with:

  • Owner or joint owner of an Occupation Order
  • Tenant Occupation Orders
  • Right to remain in the family home
  • Returning to the family home

4. Complex Consent Order Package includes

This package is for those who have multiple assets to record, for example a property portfolio or for those sharing a pension fund. This package includes:

  • A full record of assets previously divided.
  • Inclusion of a property adjustment order and related mortgage.
  • Serving the Mortgagee as required by the Family Procedure Rules.
  • Inclusion of multiple property adjustment orders and related mortgages.
  • Pension Sharing Order/s and Annex/es.
  • Serving the Pension Provider in accordance with the Family Proceedings Rules.

What’s not included

  • The process of financial disclosure, which is disclosing evidence of your income, assets, pensions etc to your spouse or their legal advisor and obtaining your spouse’s financial disclosure.
  • Negotiations for settlement are not included as it is assumed that you will each keep your own assets and that there are no assets in your joint names to be dealt with.
  • Advice on the settlement you have agreed.

Should you require advice to an appropriate settlement and help negotiating a settlement to be incorporated into a Consent Order, then you will need to pay for this additional work to be carried out based upon on usual hourly rate. Please do not hesitate to speak to one of our Family Lawyers in order to decide which package best suits your needs.

3. “Clean Break” Consent Order

This package will only be relevant to you if you have no assets to be shared and none to record as having already been shared. This order will simply enable you to each keep your own assets and have a “Clean Break” between you and your spouse. The package includes:

  • Legal advice and support regarding the Court process (not on the settlement itself), which will include up to 30 minutes personal attendance (if required).
  • Telephone calls, emails and letters to/from you, your spouse’s Solicitor and the Court concerning the Consent Order.
  • Drafting the Consent Order or approving/considering a draft Consent Order; preparing a Statement of Information and Form A application (for dismissal purposes only).

2. Divorce – Respondent – uncontested

What your divorce package includes:

  • Legal advice and support. This includes a personal attendance of up to 30 minutes discussing the divorce process.
  • Advice and guidance in relation to the Divorce Petition that will be filed by your spouse at Court; preparation of the Acknowledgement of Service form indicating your consent to the divorce and dealing with any potential cost issues.
  • Advice regarding the pronouncement of the Decree Nisi and Decree Absolute.
  • Telephone calls, emails and letters to/from you, your spouse’s Solicitor and the Court in relation to the divorce proceedings.

What’s not included

  • In the average case it will not be necessary for you to have the following and it is for this reason that they are not included in the package. In the unusual circumstance that you do need to take one of these additional steps, your solicitor will advise you of what you need, and the cost of the action required.
  • The possible “add-ons” to your package are:

Court Hearings.

If you get into a dispute with your spouse, as to whether or not you should reimburse them their legal fees of divorce (known as the Petitioner’s “claim for costs”), the Court will require you to file a statement and attend a hearing, where the Court will decide whether to order you to pay your spouse’s costs and the amount of costs to be paid.

Should you not wish to deal with this yourself, you can instruct your solicitor to draft the required statement. Our usual hourly rate will be charged for this service. You may wish to represent yourself at any hearing for costs. Should you wish to have legal representation at Court, again this will be charged at our hourly rate.
